When you need a UAE trademark registration

You are opening in the Emirates

The licence is issued and the sign goes up. The name on it belongs to whoever stands on the register, and until then it belongs to nobody.

A distributor filed your name

A partner registered the brand in their own company. Getting it back is a case with dates and evidence, and it costs more than filing would have.

The bank asks for the certificate

Customs recordals, marketplace complaints and court claims all start from one document. Without a number on it, there is nothing to attach.

Your name is written two ways

The shopfront shows one script and the packaging another. Each written form is a separate sign, and only the filed one is covered.

The renewal year has arrived

A registration reaches the end of its ten-year run. What you can still do about it depends on which month you noticed.

What is required for a UAE trade mark

A mark is registered here by the Ministry of Economy and Tourism, online, and the money leaves your account in three separate payments rather than one. Two of those payments have a thirty-day window attached, and missing either one starts a monthly charge.

The published tariff

The ministry publishes an amount for every action on its service cards. These are the official fees only; a search, drafting and answers to the office are separate work.

The two paid windows

Acceptance is not the end of the paying. The publication fee falls due within thirty days of the acceptance decision; late, it carries AED 100 a month, and a part-month counts as a whole one, up to AED 1,000 a year.

The final registration fee falls due within thirty days of the end of the objection period, and late it carries AED 1,000 a month, up to AED 10,000 a year. The certificate itself issues within thirty days of that period ending. Accepted marks appear in the official bulletin, which comes out twice a month.

What goes in the file

  • The mark as an image, in the form that will be on the product.
  • The trade licence, where the applicant is a company or an establishment.
  • A power of attorney for the agent, notarised, legalised and translated into Arabic by a certified legal translator.
  • The list of goods and services, sorted into the classes the office recognises.

An owner sitting outside the country cannot file alone: the application has to come through a registered agent, and the power of attorney travels with it. Watching the name after registration is brand protection.

If somebody objects

Anyone may object to an accepted mark, and the objection costs the objector AED 7,500. You are then notified and given thirty days to answer, after which a hearing date is set; the ministry's card puts sixty working days on the whole procedure.

Decisions can be argued with. A grievance against a refusal to register, issued by the technical inspection department, carries no fee at all; a grievance against a decision dismissing an objection costs AED 7,500, and one against a refusal to amend a registered mark costs AED 1,850.

Stages of work

The paid search — the same working day.

The ministry runs a register enquiry for AED 350 and returns the result in the same session. We will read what comes back and say whether the name can be filed as it is, needs a narrower list, or has to change.

The ministry states plainly that a clean result is not a promise of acceptance, so the reading matters more than the receipt.

Deciding the classes and the written forms.

We will settle the goods and services and the wording for them, and whether the name is filed in one script or in both.

The power of attorney and the file.

An owner outside the country files through a registered agent. We will prepare the power of attorney and take it through notarisation, legalisation and certified translation before anything is submitted.

Filing and the examination fee.

We will submit online and pay AED 750, or AED 2,250 where the one-day examination is worth it because a deal or a deadline waits on the status.

Acceptance, publication and the first window.

On acceptance the AED 750 publication fee falls due within thirty days. We will watch that date, because after it the charge runs monthly and a part-month is counted as a whole one.

The objection period and the certificate.

If nobody objects, the AED 5,000 final fee is paid inside the second thirty-day window and the certificate issues within thirty days of the period ending.

If somebody does object, you get thirty days to answer and a hearing date, and we will write the answer.

Renewals and what happens after.

Renewal is filed inside the tenth year, or in the six months after it at a higher fee, and it goes through without a fresh examination and without a new chance to object.
