Serbian citizenship by exception
Article 19 of Serbia's citizenship law lets the Government admit a foreigner whose admission serves the Republic's interest. Residence, marriage and descent are other routes; this page covers only this one.

When you need Serbian citizenship by exception

Your route is not residence or marriage
Living in Serbia, marrying a citizen and Serbian descent lead to citizenship under other articles. This page covers one: admission because it serves the Republic.
Serbia gains something from admitting you
Beyond age and legal capacity, Article 19 adds a test of its own: that admitting you would serve the Republic of Serbia. Your record has to show how.
You intend to keep your current passport
This route sets aside the usual duty to leave your present citizenship first. Whether your own country lets you hold two is a matter of its law.
Your family wants to apply too
A spouse can be admitted without the release and residence conditions. For children under 18 a parent applies, with the other parent's consent.
What Serbian citizenship by exception requires

Article 19 of the Law on Citizenship lets the Government of Serbia admit a foreigner “whose admission would be in the interest of the Republic of Serbia”. The Government decides on a proposal from the competent ministry, and the judgement is left to it.
What the law still asks of you
- Age 18 or over
- Full legal capacity
- A record that shows the Republic's interest in admitting you
What this route sets aside
- Release from your current citizenship, or proof that it will be granted
- Three years of continuous registered residence in Serbia
What is not written down
The law does not define the Republic's interest, and we found no published criteria and no statistics on these decisions.
It is also silent on whether the permanent-settlement permit named in the general rule for admission applies here. We check that point for your file before anything is filed.
Fee, decision and timing
| Parameter | Value |
|---|---|
| Republic fee for this ground | none, by statute |
| Decision fee, ordinary admission | 25,430 dinars |
| Who decides | Government of Serbia |
| Deadline in the citizenship law | none set |
| Citizenship begins | day the decision is served |
The exemption sits in the domestic tariff and covers the person admitted in the Republic's interest. Filing through a consulate falls under the consular part of the same law, and we confirm that mission's charges, and any fee for family members, before you file.
For the company side of a move, see company registration in Serbia and corporate tax in Serbia; the country overview is at Serbia, and our residence work sits in Immigration & Visas.

Stages of work
Framing the Republic's interest
We will set out what you have done or are called to do for Serbia and gather the evidence behind it. No criteria are published, so the file has to make its case on its own terms.
Preparing the documents
We will collect and translate your personal documents and prepare the application in Serbian, so that the file reaches the ministry complete.
Filing in Serbia or through a consulate
The application goes to the police directorate where you live or stay, or through a Serbian diplomatic or consular mission, which forwards it to the ministry. It can be filed in person or through an authorised representative.
Ministry proposal to the Government
The competent ministry examines the file and makes its proposal. We will answer its questions and supply what it asks for while the file is open.
Government decision
The decision is the Government's own, and the citizenship law sets no number of days for it. No administrative appeal lies against a Government decision, which is why the file is built before filing, not after.
Personal delivery of the decision
The decision is served in person. Citizenship begins on the day it is delivered to you.
Spouse and children
Your spouse can then apply without the release and residence conditions. For children under 18 you apply on their behalf, with the other parent's consent and, over 14, their own.

FAQ
Article 19 sets aside the three years of continuous registered residence that ordinary admission requires. The general rule for admission speaks of a foreigner granted permanent settlement, and the law does not say in so many words whether that applies on this route. We check this point for your file before filing, because it decides what has to be in place first. A company or property in Serbia is not among the conditions the law names.
Not under Serbian law. Ordinary admission asks for release from your foreign citizenship or proof that it will be granted, and Article 19 sets that condition aside. On Serbian territory, a citizen who also holds another nationality is treated as a Serbian citizen. Whether your present country lets you keep its citizenship after acquiring another depends on its own law, and that is worth checking before anything is filed. The same Serbian law already lets several other groups keep a foreign citizenship on admission.
The citizenship law gives no number of days for a decision on this ground. Procedures run by the ministry are classed as urgent, but the final word belongs to the Government. A firm timescale cannot be read from the law. What we can control is a complete file, filed once, with every question from the ministry answered promptly. The decision is then served in person, and citizenship begins on that day.
Yes. The spouse of someone admitted under Article 19 can apply and be admitted without the release and residence conditions. A child under 18 acquires citizenship when both parents are admitted, or on the application of one parent with the other parent's consent, whether the child lives in Serbia or abroad. A child over 14 must give their own consent as well.
The law names none. Article 19 contains no amount, no investment and no donation; its own test is whether admission would be in the interest of the Republic. The domestic part of the Republic fee schedule exempts the application and the decision on this ground. The law does not spell out what that interest is, so the file has to show it. Nor does the law tie admission to setting up a company or buying property in Serbia.
No. The law says a foreigner may be admitted, and the decision rests on the Government's own judgement of the Republic's interest. No criteria are published against which a file could be scored in advance, and no administrative appeal lies against a Government decision. What we take on is the procedure: framing the case, preparing and filing it, answering the ministry and following it until the decision is served.
