When you need Hong Kong patent registration

You already filed in China or Britain

An application at one of three recognised offices can be brought onto this register later. The door opens when it is published abroad and closes six months after.

The product has a short market life

Eight years of cover, two independent claims and no examination before grant. For a part that will be obsolete by then, the long route buys the wrong asset.

You hold a patent you cannot use

A short-term patent is granted without anyone checking whether the invention is new. Until that examination has at least been asked for, a court will not let you enforce it.

Three years have nearly passed

A direct filing waits for you to ask for examination. Ask later than three years from filing and the application is quietly treated as withdrawn.

An examination notice is on the desk

Four months to answer, and the same four months again for every further notice. Silence ends the application rather than delaying it.

What is required for a Hong Kong patent

Patents are granted by the Hong Kong patents registry, part of the Intellectual Property Department. There are two kinds and three ways to reach one, and the choice is settled by how long the invention has to earn rather than by which form is cheapest.

Three doors, and what each one asks

Up to twenty years, both formality and substantive examination, and no limit on the claims. It suits an invention that is genuinely complex.

Re-registration of a granted patent

Where the invention was first filed with the China National Intellectual Property Administration, the European Patent Office designating the United Kingdom, or the United Kingdom office, the registrar checks formalities only.

Short-term patent

Up to eight years, no more than two independent claims and no check of novelty before grant. Grant can be deferred twelve months while a search report is obtained.

The patent you cannot yet use

A short-term patent is granted on formalities and a search report. Nobody has ruled on novelty, and the registry says plainly that grant alone will not start proceedings in court.

First a certificate of substantive examination has to exist, or the examination must have been requested and not stopped by the court, or a court must have certified the patent valid. That examination costs the same four thousand dollars as a standard one, so the cheap route reaches the same counter as soon as somebody copies you.

Two six-month doors on the re-registration route

The first stage is a request to record, due within six months of the foreign application being published. This is the deadline most often lost: nothing has been granted anywhere yet and the file feels unfinished.

The second is a request for registration and grant, due within six months of the record being published here or the foreign patent being granted, whichever is later. A long wait is bridged by a maintenance fee from the fifth year.

What the registry will ask of you

  • A description of the invention, or a reference to an earlier application containing it in full.
  • The applicant identified, and a statement of who invented it.
  • For re-registration, the number, publication number and publication date of the foreign application.
  • For a short-term patent, a search report from a recognised searching authority.

Where the product also carries a name worth protecting, that is trade mark registration; whether the rights sit with the company at all is an audit of your intellectual property. A patent attorney is worth involving before a public demonstration, not after one.

The renewal calendar, and where it starts

A standard patent pays its first renewal on the fourth anniversary of the filing date that follows grant, then every anniversary to the end, at a rising rate. A short-term patent pays once before the end of the fourth year for the remaining four. Both carry six months of grace, at a late fee.

Stages of work

Matching the route to the product’s life.

We will start from how long the invention has to earn and where it is made and sold, then say which route fits and what it costs over its whole term rather than at filing.

Checking what has already been filed abroad.

If an application exists at one of the three recognised offices, we will find its publication date: the first stage counts from it, and nothing reopens that door after six months.

Drafting the claims to the right shape.

A short-term patent takes no more than two independent claims; a direct filing takes as many as the invention supports. That changes how the claims are written, so it is decided before drafting starts.

Filing, and the fee within one month.

We will submit the request with the description and the inventorship statement. The filing and advertisement amounts fall due within a month of the papers arriving.

Getting the search report or the examination in.

A short-term patent needs a search report, and grant can be deferred twelve months to obtain one. A direct filing needs a request for substantive examination, filed well inside the three years.

Answering the registrar, four months at a time.

Each examination notice gives four months for a written response or an amendment, and a further notice gives four more. We will answer inside them and say what each amendment costs.

Grant, and the calendar behind it.

You get the certificate, the published patent and the renewal dates from the fourth anniversary onwards, with the grace period marked separately so nobody leans on it by accident.
